In Rare Move, Justices Will Hold Hearing on Emergency Challenge to Air Quality Plan

The U.S. Supreme Court said Wednesday that it will hear emergency challenges from industry and Republican-led states to the U.S. Environmental Protection Agency’s “Good Neighbor Plan” to improve air quality across 23 states by reducing pollution from industrial sources.

Indiana, Ohio and West Virginia and several industry groups say the EPA’s plan violates administrative law and represents illegal overreach by federal regulators.
